One of the most common questions we get is when can I get my driving privileges back after a DWI? Individuals who are convicted of DWI crimes in Minnesota may qualify to enter the state’s Interlock Ignition Device Program. The program allows offenders to continue driving provided they adhere to program requirements and complete other terms of their sentencing. Statistics show that less than 1% of DWI offenders reoffended after enrollment in the Interlock Ignition Device Program. To date, roughly 3,300 people have successfully completed the terms of their enrollment, and a further 7,400 are currently enrolled in the program.
Eligibility
To be eligible for the program, individuals must be at least 18-years old and be eligible for a Class “D” license. They must also own or drive a vehicle, and that vehicle must be insured in accordance with state requirements. Individuals must also have no outstanding withdrawals from the program. Duration of the Program
The duration that an individual is enrolled in the program can vary from 1 year for first-time offenders (including those who refuse a breathalyzer) to up to 6 years for individuals with three or more offenses. If the offense involved great bodily harm, the duration of enrollment in the program may last up to 10 years.
Applying to the Program
There are a number of requirements that individuals who wish to apply to the program must satisfy. These include:
- Pass a DWI Knowledge Exam*
- Pay $680 to reinstate the driver’s driving privileges*
- Apply for a new Class D Driving License
- Provide Proof of Insurance
*Only if driver’s license was revoked in addition to a cancellation and denial.
Individuals will also need to select a certified ignition interlock provider from the state-sanctioned list of providers.
Finally, individuals will need to complete and sign the Ignition Interlock Participation Agreement and apply for a limited license for the times they need to drive. This agreement requires participants to pass 30 initial breath tests each month along with meeting their service and monitoring appointments. Individuals who fail to adhere to the terms of the agreement can be withdrawn from the program.
Vehicles Excluded From the Program
Individuals within the Interlock Ignition Program are not allowed to operate motor homes, motorcycles, mopeds, scooters, or recreational vehicles. Further, commercial vehicles are also excluded. Operating these vehicles while in the program can result in withdrawal and further criminal penalties.
